Is it ever WISE to break the law?
Mayor Gary Haakenson sends an email to City Councilman Michael Plunkett. Mayor Haakenson tells Councilman Plunkett that City Council President DJ Wilson is out to get him. Former Councilwoman Mauri Moore and Finis Tupper are investigating the issue. Mayor Haakenson's battle-cry to Plunkett "RALLY THREE VOTES", if Councilman Michael Plunkett thinks it is wise.
The Mayor can't vote on the meeting agenda or create the Council agenda, but objects to any Council discussion of the Street Vacation ordinance and (illegal) Temporary Construction Easement.
Here are a couple of emails between Councilman Michael Plunkett and Councilman Dave Orvis providing clear and cogent evidence of Plunkett's intent to "RALLY THREE VOTES" against hearing Item 9 on the November 2, 2009 City Council Meeting Agenda.
(Note: Plunkett has cut and pasted the Mayor's email into the body of his email without disclosing the information and request originated from Mayor Haakenson's email. Instead, Councilman Michael Plunkett says "someone" sent him this email today.)

The Hearing Examiner is set to hear the Reidy/Theusen case on November 4th. Scott Snyder and the Reidys attorney have been exchanging nasty emails. Finis Tupper has been asking questions of Wambolt. Maui Moore has made a bunch of public records requests bout the matter and she appears to working on Reidys behalf which is odd since she was financially supported by Theusen in the mayoral election two years ago.DJ met with Moore and Reidy last week. DJ has now scheduled an Exec session on the matter for next Tuesday against Mr. Snyders better judgment. He has also scheduled a full discussion agenda item after the exec session to talk about the Reidy/Theusen issue which is against Mr. Snyders advice. Scott basically says the he CP (Council President) can put whatever he wants on the agenda but advised DJ not to with Hearing Examiner case so close to conclusion which will resolve the City’s portion of the matter.

I’ve asked Sandy to make the case to DJ to remove the agenda item and only add it after the exec session if the Council sees fit.If he persists and puts it on the agenda, you may want to rally three votes to remove it from the agenda on Tuesday night if you think it wise.Just trying to keep you in the loop as what he is doing. Why he is doing it is beyond me but if he’s working with Reidy... it must be to get at you somehow.
Additional. He told Sandy about 15 minutes ago that Scott OK’d the Agenda items. Scott just called me and said he OK’d the Exec Session but not the agenda item which no one has yet seen but DJ says it is all Mauri Moore material. Apparently he is trying to get a reconsideration vote on the original ordinance approving the alley vacation.
Orvis response to Plunkett from his blackberry 7 minutes later….
Why not remove it once get to it? Or simply delay it? That we don't look we're trying squash something. -Dave
